Brockman v. LaRose, No. 20-CV-2105 (Ohio Ct. Common Pleas, Franklin Cnty.)

  Case Summary Plaintiffs, two individuals over 65 years of age (Reardon and Brockman), enjoined the court to delay Ohio’s primary election, scheduled to take place on March 17, 2020, to June 2, 2020, as was recommended by the Governor and Secretary of State of Ohio. Plaintiffs alleged that, if not enjoined, the requirements of Ohio Revised Code Sections 3501.01, 3509.03, 3511.11, 3509.08, 3505.181, 3509.06, 3513.21, 3513.22, and 3517.10, would infringe on Plaintiff’s rights as enshrined in the First and Fourteenth Amendments, and Article V Section 1 of the Ohio Constitution. The request for a temporary restraining order was denied, subsequent to which Ohio’s primary election was postponed, which mooted Plaintiff’s claims. Ultimately the case was dismissed on April 4, 2020.
