  Case Summary The El Paso County Republican Party held its County Assembly online on March 22, 2020. The party instructed delegates to submit their votes to nominate candidates to a specific email address. In the middle of the voting period, however, the party experienced a technical issue and had to re-direct delegates to a different email address. Ultimately, Larry Liston and Davie Stiver received 75% and 24% of the votes respectively. Under Colorado law, candidates need 30% or more of the vote to be nominated. Failing to meet the threshold, Mr. Stiver submitted a complaint with the Colorado Republican Party Executive Committee. As an equitable remedy, the Committee decided to designate both Mr. Liston and Mr. Stiver as candidates for the state senate seat. Petitioner Schneider sought to enjoin (1) Respondent Bremer, the Chairman of the Republican State Senate District 10 Committee, from designating Mr. Stiver as a candidate and (2) Colorado Secretary of State Griswold from certifying Mr. Stiver for the June primary ballot.

However, the Court denied Petitioner’s request to prohibit Secretary Griswold from certifying Mr. Stiver as a candidate because there was "no plausible allegation" that she would breach her duty. Petitioner motion to intervene, granted. Petitioner request to reopen evidence denied. Petition for relief under C.R.S. § 1-1-113 first claim is granted, second claim is denied.
